Claims and compensation for bullying at work
- You can negotiate exit compensation with your employer when you resign without mediation or court proceedings but you will need lots of tenacity.
- You could always go to mediation, that is a more informal experience but it could be more satisfying than the adversarial court system. Just know you will not get a “who is right and who is wrong” from the mediator.
- If you want to claim in the court contact an experienced solicitor when you have all your documents and notes ready (we could help with your preparation and thereby save you money). If they refuse to represent you it might be that your case is not strong enough or that you don’t have the necessary proof to succeed. If you go to court you will have a better idea as who is “right” and who is “wrong” by looking at the judgment and costs order but that could be very expensive.
- There are also the options of alternative dispute resolution and arbitration. Check your employment contract as your employer may have specified their preferred option.
To sue your employer you need the help of an experienced solicitor. To sue is not the issue, it will be important to the solicitor to win the case and get costs paid by the other party. Here is a fact… your solicitor can only do this when you kept full notes as discussed “How to log bullying at work?” and you have proof of all your allegations. Your solicitor my suggest some of these actions: http://www.lionglobalhr.com.au/bullyingfactsheetfornewzealand.php
